ATO issues correction about late lodgement emails to tax agents

The ATO has mistakenly issued some tax agents with an email regarding late lodgements for returns due 5 June, and reconfirmed that where these returns were received by 11 June, they are considered to be lodged on time.

In an online update, the ATO said that some tax professionals may have received an email from the ATO related to overdue lodgements which included a list of clients with outstanding obligations.

The email listed overdue lodgements for returns that were due on 5 June under certain concessional arrangements.

However, due to a systems outage which occurred on 4 June impacting the ATO’s tax professionals portals, online service for agents, PLS service and superannuation services, the ATO had previously offered an extension for these returns.

“If you lodged these returns by 11 June 2019, we consider them to be lodged on time,” the ATO stated.

“We apologise if our email caused you any inconvenience or confusion.”

5 June was the lodgement deadline for SMSFs that were eligible for certain lodgement concessions. This includes funds that are non-taxable or received a refund for the latest year lodged and are non-taxable or will receive a refund in the current year.

For SMSFs that lodge their transfer balance account reports (TBAR) annually, the report is also due on the same day as their annual return.
